Obama's attorney, Michael Jablonski, wrote the following in a letter proclaiming the defendant's refusal to appear in court:
....we will,of course, suspend further participation in these proceedings, including the hearing scheduled for January 26......
You can read the complete text of Jablonski's response to Georgia's Secretary of State HERE.
Despite the failure of anyone in the Obama camp to appear, the hearing went on as scheduled. A play by play of the proceedings can be found HERE. The Cliff's notes version is that the evidence was heard, and with no participation from the defense, appears to be irrefutable. Judge Michael Mahili has until February 4 to render his decision.
(Patriots: Consider taking a moment to send an email to Judge Mahili's office to express your gratitude at his willingness to risk his career, and possibly his life, to defend the Constitution and take on the President of the United States. In Alabama, the legal proceedings didn't go as well, as Judge Helen Shores Lee dismissed the suit, filed by Albert Hendershott, Jr.
Rumour has it that Obama's home state of Illinois will be hosting the next hearing.
